ESCAPE TO EDINBURGH - BOOKING TERMS AND CONDITIONS
GENERAL
This is a legally binding agreement between the property owner, EscapeToEdinburgh.com and the holidaymaker. The property owner is also referred to as "we" and "us".
The holidaymaker is the person who signs the booking form or, in the case of online booking, the person who makes the online payment. This person is responsible for ensuring all members of the holiday party are made aware, accept and adhere to these terms and conditions. The holidaymaker is also referred to as “Guest” or "you".
The property referred to being one of the following:
• EscapeToEdinburgh @ Albyn Place;
• EscapeToEdinburgh @ Abercromby Place or
• EscapeToEdinburgh @ Broughton Place.
These Terms and Conditions (or “House Rules”) form part of the Booking Agreement and will take primacy and apply in all cases. In making the booking the holidaymaker acknowledges their agreement to these terms and conditions.
These Terms and Conditions are made available on our website at EscapeToEdinburgh.com; at the time of booking in the Booking Confirmation; and also, in the Information Pack at each property. It is the responsibility of the holidaymaker to make themselves fully aware of these terms and conditions and to ensure that all members of their party are made aware and are compliant.
If the Holidaymaker is not in agreement with any of the terms and conditions outlined herein, then they are strongly advised to reconsider their booking arrangements and consider alternative accommodation options. By continuing with the booking after receiving these terms and conditions it will be assumed that the Guest has read and understood the terms and conditions and is accepting of them in their entirety.
BOOKINGS
Payment is required in full at time of booking or at the time determined by your booking channel to secure your reservation. Depending on the website the guest made the reservation with, full payment is taken either at the time of booking or at 14 days before arrival. If the booking was made via a travel website they will normally take the payment directly and hold the funds until after the stay. If the guest made the reservation directly with EscapeToEdinburgh.com then a charge for the booking will be made against the credit card provided. If no credit card has been supplied then the guest will be contacted to make payment.
Unless the guest has booked with a Non-Refundable Payment Plan or via a Flexible Cancellation Plan, the reservation can be cancelled at any time up to 14 days before the arrival date and a 100% refund will be made. If the guest cancels the booking within 14 days of the arrival date then no refund will be made.
Unless a national state of emergency is declared in Scotland, any other event is not considered grounds for any refunds for cancellations made within the 14 days before arrival.
Failure to pay the Reservation in full when requested to do so will constitute a cancellation of the holiday by the holidaymaker.
CANCELLATION BY THE HOLIDAYMAKER
Cancellation of the booking by the holidaymaker should be made directly with the booking channel the booking was made with or if the booking was made directly with EscapeToEdinburgh.com by writing to: Hello@EscapeToEdinburgh.com
CANCELLATION BY THE PROPERTY OWNER
The property owner will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event the property becomes not available and the property owner has to cancel the booking, the property owner will endeavour to find the holidaymaker suitable alternative accommodation. If suitable alternative accommodation cannot be found, the holidaymaker shall be entitled to a full refund.
The property owner shall only be liable to return the booking fee that was paid. No other compensation or consequential losses shall be paid.
MISCELLANEOUS
Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.
Only the person who is named on the Booking form can do the Check in. In making the Booking a valid contact phone number is requested. If the Guest does not provide a valid phone number at the time of Booking and we are not able to contact the Guest prior to check in then the Reservation will be cancelled without refund.
The Guest agrees that they will consult the Property Information Manual (Guide Book) in the first instance should they have any queries regarding the property and will not contact the host before reading the Information Manual.
The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.
The property owner is entitled to ask the holidaymaker to leave the property without refund if, in the property owner's opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.
The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable or capable of taking charge of the property or has clear intent to violate the House rules (eg; disturbance to neighbours, Party, Hen or Stag event).
The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.
NUMBER OF PEOPLE ALLOWED
The maximum number of people (guests or others) entitled to be in or on each property at any one time is as follows: Escape To Edinburgh @ Albyn Place (2 people);
Escape To Edinburgh @ Abercromby Place (5 people);
and Escape To Edinburgh @ Broughton Place (4 people),
Furthermore, only the number of people registered for the booking (either the number identified at time of booking or if subsequently changed, the number as advised by the guest to the owner prior to the day of arrival) are entitled to stay. All Guests must be declared at the time of booking.
If it is found during the stay that more people than agreed are staying at or visiting the property (guests or others), this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without refund.
Sub-letting or assignation of the let is prohibited.
EscapeToEdinburgh.com are family friendly but children must be supervised at all times. As stairs are present in all our properties, we do not recommend them for any children under the age of 12. Any children staying must be declared at the time of booking on the Booking Form.
PETS
Pets are not allowed into the property. If a pet is found to be in the property then this would constitute a breach of contract and the holiday maker may be asked to leave without refund. The holidaymaker would be liable for all damage caused by his/her pet. A charge will be made for any additional cleaning required. The property owner cannot be held responsible for any accident or injury to a pet.
ARRIVAL AND DEPARTURE TIME
Every effort will be made to have the property available from 1600 on the day of arrival. Latest check in time is 2100. Only the Guest who made the Booking and is and is named on the Booking form can check in.
THE PROPERTY MUST BE VACATED BY 1100 HOURS ON THE DAY OF DEPARTURE
Any unauthorised late departure beyond 1100 will result in additional charges being incurred by the guest. Any departure after 1100 will incur an automatic £50 unauthorised check out fee. If the property is not vacated by 1200 on the day of departure the guest will be liable to an additional and further charge equivalent to the normal daily rate for that day. This will not entitle the guest to stay another day. If the guest wishes to extend their stay then they will have to formally make a booking request to do so and it will be subject to availability. If the guest’s late departure has an impact on the next guest checking into the property then the departing guest will be responsible for any consequential costs or losses occurring as a result including potential refunds to the next guest as a consequence of their late unauthorised check out. We kindly ask all guests to observe this policy in order that the next Guests’ arrival is not disrupted.
In most cases the guest will be met personally, but where this is not possible information about keys and how to collect them will be provided once full payment has been received and prior to the arrival date. If the Guest does a self-check-in then they certify that they are able and willing to follow the instructions that will be provided to do so that will be made available by the Host.
BAGGAGE STORAGE
Unfortunately, we are not able to store guest bags or luggage either before check in (1600–2100) or after check out (1100) as there are no staff resident on site. However, there are third party luggage storage facilities and options available and details are provided separately.
LIABILITY & ACCESSIBILITY
The property owner takes no responsibility for the personal possessions of the holidaymaker or the holidaymaker's party. Vehicles and possessions are left entirely at the risk of the holidaymaker.
All our properties have stairs to the property and in some cases within the property itself and therefore risk exists. If the guest feels this may be a risk for them or any other members of their party then this should form part of the consideration when choosing to stay with us.
The Property owner accepts no liability for any resulting accidents. The Property Owner will not accept any liability for the Guest wishing to cancel the booking within 14 days of arrival due to potential accessibility issues the Guest did not anticipate nor enquire upon prior.
CLEANING
We would like to think the holidaymaker and party would treat the property as they would their own home and at the end of the holiday the property is left in a clean and tidy condition. The property owner retains the right to make an additional charge for cleaning should the property not be left in a similar condition to the way it was found at the start of the holiday.
HEALTH MEASURES & LIABILITIES
Whilst we have put in place preventative measures to reduce the spread of any viruses, we cannot guarantee that infection will not occur. In agreeing to stay with EscapeToEdinburgh.com the guest accepts these booking terms and conditions, and in so doing the guest agrees to fully discharge EscapeToEdinburgh.com from any liability or claim arising from illness, injury, death or medical treatment that may arise during or after their stay.
PARTIES OR GROUPS
NO PARTIES, HEN OR STAG EVENTS ARE PERMITTED UNDER ANY CIRCUMSTANCES
This is made explicitly clear at the time of booking and in all communications with the guest prior to arrival. Any such events will constitute a breach of the agreement and the guest will be denied access on arrival or asked to leave immediately without refund. No exceptions will be made.
BREAKAGES/DAMAGES
The holidaymaker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages must be reported to the property owner (or their representative) prior to departure. The property owner retains the right to make an additional charge for all damage and breakages. We are not a hotel - this is our home. We go to great lengths to make sure our guests have a comfortable and welcoming stay. We hope our guests will be respectful of our property and belongings and respectful of our neighbours and other residents. Compensation will be pursued for any damages or breakages.
REMOVAL OF ITEMS
In each property several items are made available for use by the guests(s) during their stay. These items are not to be removed. If any items are removed by the guest then the property owner reserves the right to make a charge upon the guest for the item’s replacement.
HOUSE KEYS
The guest is provided with a set of keys during their stay. In the event these keys are lost or go missing and are not returned at the end of the stay then a charge of £25 will be made for replacement.
NO SMOKING
All our properties are strictly Non-Smoking.
This restriction applies to all rooms inside our properties and to the public areas of the building itself (for example: reception hallway, courtyard, outside the front door to the building and apartment etc). This is to respect non-smokers who stay at our properties and also our neighbours. If the Guest or a member of their party does smoke in contravention of these terms then additional charges will apply to cover specialist cleaning costs.
PARKING
On some booking websites they may indicate the availability of "Parking" without specifying exactly what parking is available. However, guests should note that there is no "free" parking available at our properties. There is on street metered parking (which is actually free on Sunday mornings and on other days between the hours of 1830 and 0830) or there is long stay multi storey parking available only.
COMPLAINTS
Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from to time things do go wrong. In these circumstances, it is the responsibility of the holidaymaker to make any such problem known to the property owner (or their representative) immediately it becomes apparent, thereby giving the property owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.
The property owner will make every endeavour to rectify any identified problems as soon as is reasonably possible. In making any complaint the Guest also immediately gives authorisation to the Host or their agent to immediately access the property to remedy any issues. Failure to allow access is a violation of our terms and conditions.
RETALIATION
The Guest agrees that they are making their booking with EscapeToEdinburgh.com with good will. Furthermore, the Guest will not seek to damage the Hosts business because they are not happy with a ruling or decision taken either by the Guest’s Booking Channel or the Host in the event the Guest experiences something dissatisfying during their stay or because the Guest loses a Resolution claim related to non-compliance with these Booking Terms and Conditions or House Rules with either their Booking Channel or the Host.
